1. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE AND CONCLUSION OF THE CONTRACT

The contract concluded between Ser.Com Srl (hereinafter “SER.COM”) and the Customer (a natural person who makes a purchase on the Store) is considered concluded with the acceptance, even partial, by SER.COM of the Customer’s purchase order for the product (Product) on sale. In case of non-acceptance of the order (e.g., due to product unavailability in stock or an evident manufacturing defect that prevents its use or sale), SER.COM will promptly notify the Customer and refund the Product’s amount using the payment method originally used by the Customer.

By placing an order using any of the available methods and completing the order form on the Store (the “Order”), the Customer declares to have read all the instructions provided during the purchase procedure and to fully accept these general conditions of sale and contract conclusion (the “Conditions”).

These Conditions may be printed or saved on a durable medium, in accordance with Articles 12 of Legislative Decree 70/2003 and 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

The Customer acknowledges and accepts that, upon acceptance (in whole or in part) of the Order by SER.COM, the sales contract is considered concluded between the Customer and SER.COM (as the seller and licensee of the MIB brand), and that MIB Trieste is not in any way involved or responsible for the established contractual relationship.
2. PURCHASE METHOD

The Products available for sale through the procedure outlined in these Conditions are only those shown on the Store at the time of submitting the Order and as described in the relevant information sheets.

Product images accompanying the descriptions are for illustrative purposes only and may not perfectly reflect the product’s features (e.g., in terms of color and size), depending on the browser and monitor used.

To place an Order, the Customer must fill out the relevant form on the Store in full and submit it after reviewing the Conditions and the characteristics of the product(s) they intend to purchase. If desired, the Customer must request a tax invoice from SER.COM.

SER.COM confirms receipt of the Order by sending an email to the address provided by the Customer. This email will summarize the order conditions, as required by law, along with the order details so that the Customer may verify and, if necessary, request corrections.
3. CUSTOMER OBLIGATIONS

When placing their first order, the user is automatically registered.
-
The Customer agrees to provide accurate, truthful, and complete data and must retain a copy of the purchase confirmation email sent to the address provided during registration.
4. PRICES AND PAYMENT METHODS
-
Prices shown on the website exclude taxes and VAT applicable to the relevant product categories. Shipping costs are not included in the product price but will be communicated to the Customer via the site or these Conditions.

In compliance with Art. 17-bis of the Consumer Code (Leg. Decree 206/2005), whenever a price reduction is announced, SER.COM will also indicate the “previous price,” meaning the lowest price applied to the general public in the 30 days prior to the reduction. For gradual price reductions during a single sales campaign, the “previous price” is the price before the first reduction.

The total price at checkout includes shipping costs but excludes any import duties or additional sales taxes for international shipments.

Payment must be made in advance via PayPal or credit card. Payment information is processed via a third-party provider (including the Stripe infrastructure).

All orders are subject to verification. SER.COM reserves the right to request identification documents via Customer Care. If the Customer fails to provide such documents within 72 hours, the order will be canceled and a standard refund issued.
5. DELIVERY AND RELATED COSTS

Orders will be processed within 48/72 hours after SER.COM’s acceptance, at the cost specified on the Store before order confirmation. Shipping is handled by leading national and international couriers.

For deliveries outside the EU, import customs duties will be borne by the recipient. Customers are advised to contact their local customs office beforehand. Estimated delivery times are: (i) Italy: 24/48 hours; (ii) Italian Islands: 48/72 hours; (iii) Europe: 48/72 hours; (iv) Rest of the World: 48/72 hours.

Stated delivery times are estimates. Delays do not entitle the Customer to cancel the order or claim compensation.

Upon delivery, the Customer must check:

the number of packages matches the transport document,
-
the packaging is intact and not damaged or altered.

Any damage or discrepancies must be noted immediately on the delivery document and reported within 14 days.
6. RIGHT OF WITHDRAWAL / RETURNS

Pursuant to Art. 52 of Leg. Decree 206/2005, as amended by Leg. Decree 21/2014, the Customer may withdraw from the purchase contract within 14 business days of receiving the Products, without giving any reason or incurring penalties. If the Customer designates a third party to collect the item, the withdrawal period begins upon delivery to that person.

To exercise the right of withdrawal, the Customer must email SER.COM at mibshop@sercom.com within the above timeframe, replying to the order confirmation email.

The Customer must return the Product at their expense within 14 days to: Ser.Com Srl, Via L. Braibanti No. 15 – 29122 Piacenza (PC).

The Product must be returned intact, complete with all parts and in the original packaging, used only to verify its nature, features, and size, without signs of wear or dirt. The following apply:

The right applies to the whole product;
-
Excluded items: customized/pre-order items, perishable goods, unsealed items unsuitable for hygiene reasons;

Returns must include original packaging and accessories;
-
Return shipping is the Customer’s responsibility;
-
The Customer bears the risk of loss/damage during return shipping.

If the item is damaged in return transit, SER.COM will notify the Customer, make the item available, and cancel the return. SER.COM is not liable for any damage or loss during return shipping.

SER.COM will refund the Customer within 14 days, net of any extra shipping charges, using the same payment method unless agreed otherwise. SER.COM may withhold the refund until it receives the item or proof of return.

If the right of withdrawal is not valid, the Product will be returned to the Customer, who will bear the shipping costs.
7. WARRANTIES

All Products are covered by a 24-month warranty for conformity defects under Title III of Legislative Decree 206/2005.
-
Manufacturer warranties also apply.

If a defective or non-conforming Product is received, the Customer has the right to repair or replacement free of charge, if the defect is reported within 2 months of discovery and within 24 months of delivery.
-
The warranty applies if the Product is used properly according to its instructions.
-
If SER.COM cannot repair or replace the item (e.g., due to cost), it may offer a partial refund or cancel the contract.
-
In warranty cases, Products must be returned with complete original packaging.
-
The Customer must report defects via email. SER.COM will organize and cover return shipping for faulty or non-conforming items.
8. FORCE MAJEURE

Neither party will be held liable for delays caused by circumstances beyond their reasonable control. The affected party is entitled to an extension to fulfill their obligations.

10. PRIVACY

11. GOVERNING LAW

These Conditions and related sales contracts are governed by Italian law, excluding conflict-of-law rules and the UN Convention on the International Sale of Goods. Disputes will be resolved by the court of the Customer’s place of residence.

According to Art. 141-sexies of the Consumer Code, if a dispute cannot be resolved through a complaint, SER.COM will inform the Customer about alternative dispute resolution bodies and whether it intends to use them.

The Customer’s right to take legal action before a competent court remains unaffected.
Acceptance of contractual clauses pursuant to Articles 1341-1342 of the Italian Civil Code

Pursuant to Articles 1341 and 1342, second paragraph, of the Italian Civil Code, the Customer specifically approves the following clauses:
